Terms of Service

Plain English where possible. Where it has to be precise, it's precise. These terms cover website builds, the monthly and annual care plan, and everything in between.

Section 1

Who these terms apply to

These terms are between Studio Velox (the trading name of Open Mind Developments Pty Ltd, ABN 37 145 201 261, Gold Coast, Queensland) and any individual or business ("you" or "the client") who engages Studio Velox for a website build, care plan, or other services.

By paying a deposit, signing off on a build, or starting a free trial, you agree to these terms.

Note on GST: Studio Velox is not currently registered for GST. Our turnover is under the $75,000 threshold. Prices shown are the full amount — no GST is added on top.
Section 2

Website builds

One-page site — the build is free when paired with an active care plan. No build fee is payable at any point. There is no minimum term: the care plan may be cancelled at any time after the free trial ends, and nothing further is owed.

Five-page website ($497) — a one-off fee covering the scope agreed before work starts. The build includes:

Five pages with assistant ($997) — everything in the five-page build, plus a scripted text assistant on the site. The assistant answers only from information you have supplied and approved. It does not generate answers of its own, does not take payments or card details, does not book into a calendar, and operates in English only. Anything it has not been given, it refers to you.

Extra pages beyond those included are quoted before work begins.

Anything outside this scope — copywriting from scratch, photography, e-commerce, booking systems, additional pages, logo design — is quoted separately as a fixed price for the agreed work, confirmed in writing before work begins.

Payment: no deposit is taken. You see the completed site before you pay for it. The build fee is due within 7 days of completion. The one-page build carries no fee at all.

Revisions: the one-page build includes 1 round of changes; the five-page builds include 3. Further rounds are quoted as a fixed price before the work is done.

Timeline: Studio Velox aims to have a site live within 7 days of receiving all required content from you. Delays caused by late content from the client extend that period by the length of the delay, and are not Studio Velox's responsibility.

Section 3

The care plan

There are three care plans. Each includes everything in the one before it.

$47/month (or $470/year)

$97/month (or $970/year) — all of the above, plus:

The care plan does not include new pages or sections, redesigns, advertising, SEO campaigns, AI tools, copywriting, photography, or third-party costs such as domain registration fees or booking platform subscriptions.

A "small change" is anything that takes well under an hour. If a request is larger than that, you'll be told the cost before any work is done — never after.

Section 4

Billing and payment

Monthly care plans are billed automatically via Stripe on the same date each month. Annual plans are billed once per year. You can update your payment details at any time through the link in your Stripe billing emails.

If a payment fails, Stripe will retry automatically and send you a notification. If payment remains outstanding after reasonable attempts, Studio Velox reserves the right to suspend the site until the account is settled.

Bigger jobs are quoted as a fixed price and invoiced separately. Payment terms are 7 days from invoice date.

Studio Velox is not registered for GST. Invoices will not include a GST component.

Section 5

Free trial

The trial begins on the day your completed site is presented to you, not on the day you enquire.

Nothing is charged until the trial ends, and you will receive a reminder beforehand. During the trial the site is hosted on a Studio Velox address; it is moved onto your own domain once the first payment has cleared.

You can cancel during the trial at no cost and nothing further is owed, including any build fee. If you cancel during the trial the site is not transferred to you and is taken offline.

Section 6

Annual plans and refunds

Annual plans are billed upfront at 12 months for the price of 10: $470 instead of $564, $970 instead of $1,164, or $1,470 instead of $1,764, depending on the plan. The build fee, where one applies, is unchanged.

Refund policy: Annual plans are non-refundable. If you choose to cancel before the 12 months are up, the remaining months will not be refunded. Your site will stay live until the end of the paid period, and you will keep the site files — they are yours.

If Studio Velox is unable to continue providing the service for any reason, a pro-rata refund of the unused portion will be issued.

Section 7

Ownership of your site

The website belongs to you. The domain is registered in your name. The site files are yours. Studio Velox does not claim any ownership over your content, your design, or your domain.

Content you supply — text, photos, logos, videos — remains your property at all times.

Code and design created by Studio Velox for your site becomes your property once the build is paid for in full.

Section 8

Leaving and handover

You can cancel the care plan at any time. Monthly plans: cancellation takes effect at the end of the current billing period. Annual plans: cancellation takes effect at the end of the paid year — no refund for unused months.

If you leave, Studio Velox will:

If your site uses Cloudflare Email Routing through the Studio Velox account, you will need to set up your own Cloudflare account and reconfigure email routing. Studio Velox will provide clear written instructions to make this straightforward.

The short version: if you leave, you take your site with you. There are no lock-ins, no held hostage domains, and no gotchas.
Section 9

Liability

Studio Velox takes reasonable care to keep your site running, secure and up to date. However, no hosting service can guarantee 100% uptime, and Studio Velox cannot be held liable for losses arising from downtime, third-party service failures (including Cloudflare, Stripe, or domain registrars), or events outside our reasonable control.

Studio Velox's total liability in any circumstances is limited to the fees paid by you in the 3 months preceding the event giving rise to the claim.

These terms are governed by the laws of Queensland, Australia.

These terms may be updated from time to time. The current version is always at studiovelox.com/terms. Continued use of the service after an update constitutes acceptance of the revised terms.
